About this service

These terms apply to the Three Fountains Shopping Centre website and its leasing enquiry channels, including automated WhatsApp and email responses. The leasing service is administered by Assegai Assetco (Pty) Ltd, registration 2020/713940/07, at 13 Azalea Lane, Mount Michael, Hilton, 3245, South Africa. Contact: [email protected].

These terms govern use of the information and enquiry service. They do not replace a signed lease, separately agreed commercial terms, the application form or rights that applicable law does not allow us to exclude.

Centre information and rental indications

Published areas, layouts, tenant programmes, opening dates and construction milestones are information about a development and may change. Images, renders and indicative plans are illustrative. A listed tenant or logo does not, by itself, establish an executed lease or a guaranteed opening date.

Availability and rental indications are subject to confirmation in a written quotation or offer. Unless expressly stated otherwise, a basic rental is not an all-inclusive occupancy cost. A formal quotation must address applicable VAT, recoveries, utilities, deposits and other charges. Proposed shop splits, uses, fit-out arrangements and technical requirements require agreement and any necessary approvals.

An enquiry, chatbot response, indicative quotation, form download or application submission does not reserve premises or constitute lease approval. No lease is concluded through the automated enquiry service. A tenancy requires the applicable approvals and a written lease signed by the relevant parties.

Applications and documents

Submit the completed tenant application/KYC form and supporting documents to [email protected]. You are responsible for providing accurate, relevant information and for being authorised to act for the applicant and provide other people's information. Notify us of material changes.

Receipt of an email is different from confirmation that its attachments were stored, read or accepted. An application described as complete has passed a document-completeness stage; it has not necessarily passed authenticity, reference, credit or commercial assessment. Do not pay a deposit or assume premises are secured solely because an automated response was received.

Automated responses

The service may use automation and AI to provide information and assist with administrative checks. Responses can contain errors or omit context. Ask for clarification or human review at [email protected] if an answer appears incorrect or affects a decision you intend to make. The automated assistant cannot approve a lease, grant exclusivity, vary signed terms or guarantee a booking.

Site visits

A requested date is not a confirmed appointment. Wait for a confirmed time, meeting point and access arrangements before travelling. The centre is a construction site: access is controlled, and visitors must follow the site's safety instructions. Do not enter without authorisation.

Acceptable use

Use the service lawfully and respectfully. Do not impersonate another person, submit fraudulent documents, attempt unauthorised access, distribute malicious files, interfere with the service or seek another applicant's private information. We may restrict misuse while preserving applicable legal rights and lawful access to records.

The service is intended for people able to enter commercial arrangements and authorised business representatives. Do not submit children's personal information unless specifically requested for a lawful and necessary purpose.

Privacy and third-party services

Our Privacy Policy explains personal-information processing, including service providers and AI assistance. Third-party platforms such as WhatsApp also have their own terms and privacy notices. Their availability and operation are outside our direct control.

Content and availability

Website text, images, plans and branding belong to their respective owners. You may use supplied information for a genuine enquiry or application. Do not reproduce, alter or commercially distribute protected material without the necessary permission or another lawful basis. Tenant trademarks remain the property of their owners.

We aim to provide useful and accurate information but do not promise uninterrupted service or error-free automated responses. Report errors to us so they can be investigated. Nothing in these terms excludes liability or a remedy that South African law does not permit us to exclude, or limits responsibility for fraud or wilful misconduct.

Applicable law and changes

These terms are governed by South African law. A dispute may be referred to a competent court or other body with jurisdiction; these terms do not remove applicable statutory complaint or consumer remedies.

We may update these terms prospectively and show the effective date on this page. An update does not, by itself, change an existing signed lease.
